1. Introduction
Regional Broadband provides broadband services designed to deliver reliable, high‑quality internet access for residential and business customers.
Our broadband packages are advertised as “unlimited”, meaning that customers are not normally subject to fixed monthly data caps. However, to ensure that the network operates efficiently and that all customers receive a consistent level of service, this Fair Usage Policy (“Policy”) sets out the acceptable use of our services.
This Policy forms part of the Regional Broadband Terms and Conditions and applies to all customers using Regional Broadband services.
2. Purpose of this Policy
The purpose of this Policy is to:
- Ensure fair and equitable use of network resources;
- Protect the integrity, performance, and security of the Regional Broadband network;
- Prevent activities that may negatively affect other customers’ access to the service;
- Ensure compliance with applicable Irish and European Union law.
Regional Broadband supports the principles of an open internet and complies with Regulation (EU) 2015/2120 (Open Internet Access Regulation) and applicable guidance from the Commission for Communications Regulation (ComReg).
3. Unlimited Usage and Reasonable Use
Regional Broadband residential services are intended for personal household use. Business services may be used for normal business activities but are not intended for carrier or wholesale usage. Example typical usage activities are such as:
- Web browsing
- Streaming video and audio
- Video conferencing
- Online gaming
- File downloads and uploads
- Remote working and using cloud services
While our services are marketed as unlimited, usage must remain reasonable and consistent with normal consumer usage patterns.
Usage may be considered unreasonable where it:
- Has a material adverse impact on the performance of the Regional Broadband network;
- Degrades or disrupts service for other customers;
- Involves the resale or redistribution of the service without Regional Broadband’s prior written consent;
- Uses the service in a manner that circumvents any network management or security controls;
- Involves continuous or automated high‑volume data transfers significantly outside normal residential usage patterns where the service is residential;
- Involves continuous or automated high‑volume data transfers significantly outside normal commercial usage patterns where the service is commercial;
- Involves use that can be considered data centre, commercial hosting, or server farm use;
- Involves automated traffic from activities such as:
- Botnets
- Crypto mining clusters
- Distributed workloads
4. Network Management
Regional Broadband may implement reasonable network management practices where necessary to:
- Maintain network stability and performance;
- Prevent congestion or service degradation;
- Protect against malicious traffic, security threats, or network abuse.
These network management practices may include, but are not limited to:
- Congestion management: temporary and application-agnostic rate limiting during exceptional or temporary congestion;
- Security protections: blocking or filtering of traffic confirmed as malware/botnet activity to protect the network;
- Service integrity controls: preventing spoofing, amplification attacks and denial-of-service attacks.
Any such measures will be transparent, proportionate, and non‑discriminatory and will comply with EU Open Internet Regulation.
We do not inspect the content of your communications except where strictly necessary for network troubleshooting, security incident response, or where required by law. We may process traffic and technical metadata for the purposes of providing the service, billing, network security, fraud prevention and compliance with legal obligations, as described in our Privacy Policy.
5. Excessive or Abusive Usage
If a customer’s usage significantly exceeds what Regional Broadband considers typical for the service provided, and that usage negatively impacts network performance or other users, Regional Broadband may take reasonable steps to address the situation.
Such steps may include:
- Contacting the customer to discuss the usage;
- Requesting that the customer reduce or modify their usage;
- Applying temporary traffic management measures where necessary;
- Recommending an alternative product more suitable for the usage profile;
- In extreme or repeated cases, suspending or terminating the service in accordance with the Terms and Conditions.
Where possible, Regional Broadband will provide reasonable notice before taking enforcement action, except where immediate action is necessary to protect the network.
6. Prohibited Activities
Customers must not use the service for activities that:
- Are illegal under Irish or EU law;
- Interfere with or disrupt the Regional Broadband network;
- Attempt to gain unauthorised access to networks, systems, or data;
- Distribute malware, viruses, or malicious software;
- Involve the resale or redistribution of the service without explicit written permission by Regional Broadband;
- Cause harm to Regional Broadband systems or other users.
Regional Broadband reserves the right to report suspected illegal activity to the appropriate authorities where required by law.
7. Compliance with Law and Regulation
Customers must comply with all applicable laws and regulations when using Regional Broadband services, including but not limited to:
- Irish communications legislation;
- European Union telecommunications regulations;
- The Open Internet Access Regulation (EU) 2015/2120.
Regional Broadband may be required by law to assist regulatory authorities or law enforcement agencies in investigating unlawful activity.
8. Changes to this Policy
Regional Broadband may update or amend this Fair Usage Policy from time to time to reflect:
- Changes in network technology;
- Changes in regulatory requirements;
- Changes in industry best practices.
The latest version of the policy will always be published on the Regional Broadband website. Continued use of the service after any updates constitutes acceptance of the revised Policy.
